This property will be sold with a reserve of $970.00 per acre & will sell at or above that bid amount.

TERMS AND CONDITIONS

Down Payment: $20,000 non-refundable earnest money on the parcel will be paid on the day of auction, in the form of a cashier’s check made payable to yourself, to be endorsed to Fahey & Associates Inc. if you are the successful bidder. The successful bidder will be required to enter into a written purchase agreement with the Sellers immediately following the close of bidding. A copy of the agreements are available for inspection at the office of the auctioneer or at the auction site. If for any reason, (except Seller’s default), the bidder fails to close the transactions, the earnest money will be forfeited.

Closing: Closing on the property will take place at the Title Company of the Sellers choice on or before September 15, 2009, the date of closing and possession.

Financing Terms: $20,000 non-refundable earnest money down on the purchase agreement the day of auction.. The balance in full due on or before September 15, 2009 the date of closing and possession. Buyer to have financing arrangements made prior to the auction with no contingencies of any kind accepted day of auction. 1031 tax exchange language is available in the purchase agreement, however, any 1031 tax exchange shall not alter the terms, conditions, or closing date in these transactions. 

Title: The property will be sold free and clear from any and all liens and encumbrances, but subject to any easements, restrictions, zoning, environmental, or other municipal, federal and state laws, right of way or other matters of record. The Seller’s will provide the buyer with an updated abstract and the buyer is permitted 15-days to examine title.

Taxes: The real estate taxes due and payable in the year 2009 will be prorated to the day of closing.
