DOWN PAYMENT: $2,500 non-refundable earnest money will be paid to Fahey & Assoc Inc Trust Account on the day of the auction. The successful bidder will be required to enter into a written purchase agreement with the owner immediately following the close of bidding. A copy of the agreement is available for inspection a the office of the auctioneer or at the auction site. If for any reason, (except Seller’s default) the bidder fails to close the transaction the earnest money will be forfeited. CLOSING: Closing on the property will take place a the office of the Seller’s Title Company on or before October 27, 2008, the date of closing and possession. FINANCING TERMS: $2,500 non-refundable earnest money. The balance in full due on or before October 24, 2008 the date of closing and possession. Buyer to have financing arrangements made prior to the auction with no contingencies of any kind accepted day of auction. The property will be sold without a reserve price to the highest bidder. TITLE: The property will be sold free and clear from any and all liens and encumbrances, but subject to any easements, restrictions, zoning, environmental, or other municipal, federal and state laws, right of way or other matters of record. The Seller’s will provide the buyer with an updated abstract, and the buyer is permitted 15-days to examine title. TAXES: The real estate taxes due and payable in the year 2008 will be prorated to the day of closing. SELLER’S & AUCTIONEER’S DISCLAIMER: All announcements made by the auctioneer the day of auction shall take precedence over any previously written material or oral statements made. Conduct of the auction, increments of the bidding and decision as to the high bidder will be a the sole discretion of the auctioneer. Dual agency may apply.
